This route is for businesses that have an established presence outside the UK and would like to set up a branch or subsidiary in the UK. For this, they would like to send an employee who has worked for the company for some time to the UK to represent their overseas business in UK. This route does not require the applicants to show a certain amount of funds in their possession. Initial application: Sole Representative

In order to qualify for a sole representative visa for the UK, you will need to show that:

  • You are a senior employee of a business which has its headquarters and principal place of business outside the United Kingdom; and
  • The overseas business has no branch, subsidiary or another representative in the United Kingdom; and
  • You have full authority to take operational decisions on behalf of the overseas business; and
  • The branch or subsidiary in the UK will carry out the same business activity as the overseas business; and
  • You do not intend to take any other employment in the UK; and
  • You are not a majority shareholder in the overseas business; and
  • You can maintain and accommodate yourself adequately without recourse to public funds; and
  • You have competence in the English language to the required standard.

Length of visa: The initial grant will be for a period of 3 years.

Dependants
Your family members (your husband, wife or partner and your child under 18) can come with you as your dependants on this visa.

Extension application: Sole Representative
To extend your stay in the UK as a representative of an overseas business, you will need to show that:

  • You are still working for the same employer and have established the company’s first presence in the UK; and
  • Your employer’s principal place of business remains outside the UK; and
  • You are still required for the employment in question, as certified by your employer; and
  • You can maintain and accommodate yourself and any dependants adequately without recourse to public funds.

Length of leave: The extension will be granted for 2 years.

Settlement applications: Sole Representative
To qualify for indefinite leave to remain in the UK as a representative of an overseas business, you will need to show that:

  • You have spent a continuous period of 5 years lawfully in the UK and have met the requirements of the sole representative route throughout the 5 year period; and
  • You are still required for the employment in question, as certified by your employer; and
  • You have not spent more than 180 days outside the UK in any of the five consecutive 12 calendar month periods preceding the date of application; and
  • You have demonstrated sufficient knowledge of the English language and life in the United Kingdom.

Fees
